Terms of Use

By joining the waitlist, downloading, installing, purchasing, or using Yomify, you agree to these Terms and the Privacy Policy. If you do not agree, do not join the waitlist or use the app.

You must be legally capable of entering these Terms. If you are under 18, you may use or purchase Yomify only with permission from a parent or legal guardian who agrees to be responsible for the purchase and your use of the service.

Yomify is currently in pre-launch and is not yet available for public download. Joining the waitlist is free, requires a valid email address and explicit email consent, does not create a purchase, and does not guarantee a particular launch date.

A person who remains actively subscribed when Yomify launches is eligible to receive one private code for 50% off one eligible Yomify lifetime license at the then-current regular price. The discount is for the lifetime license purchase; it is not a recurring 50% discount on unrelated future products, services, taxes, upgrades, or add-ons. The code is personal, may not be sold or transferred, cannot be combined with another promotion unless expressly stated, and is subject to any checkout eligibility details disclosed with the launch email. Mandatory consumer rights are not limited.

Yomify grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Macs you control, subject to these Terms. Free includes ten Live Highlights per Japan Standard Time calendar day and local dictionary and reading tools; reading history is unavailable on Free. When you are signed in, the daily count is synchronized to your account; otherwise it is enforced locally on that Mac.

Yomify Standard is a one-time ¥1,500 JPY purchase that provides unlimited Live Highlights and a 20-item history. Yomify Premium is a one-time ¥2,000 JPY purchase that adds Area Capture, unlimited history, and flashcards. A Standard owner may upgrade to Premium once for ¥500 JPY.

These purchases are not subscriptions. There is no recurring charge or automatic renewal. Paid licenses include future Yomify app updates at no additional license charge while the product is maintained. Trial and paid features are licensed to one account and one active Mac; you may deactivate or move the current activation before using another Mac.

An eligible signed-in account and installation receive one three-day Premium trial. The trial ends automatically, does not convert into a paid plan, and does not charge you. Premium continues only if you separately choose and complete a purchase. The trial cannot be repeated by creating or reusing accounts or installations.

You are responsible for maintaining access to the Google account used with Yomify and for activity performed through it. Do not share or resell your Yomify account, manipulate the daily allowance, repeat a trial, or bypass device or entitlement checks.

Once sales open, payments will be processed by Stripe. Promotion codes, including an eligible waitlist code, may be entered at checkout. The final product, one-time amount, discount, and any applicable tax will be shown before you confirm payment. A paid plan is activated only after Stripe reports a successful payment and Yomify verifies the entitlement through Supabase. Stripe's payment terms also apply to its processing services.

Yomify offers a seven-day refund policy described on the Refund Policy page. A full refund or payment dispute may reduce or revoke the affected paid tier and deactivate associated paid access. Statutory consumer rights are not limited.

• Do not use Yomify to violate law, privacy, copyright, or another person's rights.
• Do not interfere with the service, probe protected systems, distribute malware, or automate abusive traffic.
• Do not circumvent licensing, payment, security, or device-limit controls.
• Do not redistribute the app or sell access without written permission.

Dictionary entries, readings, OCR, translations, and pronunciation are learning aids and may be incomplete or incorrect. Yomify is not professional, legal, medical, or certified translation advice. Check important text against an authoritative source.

Yomify has not launched publicly, and no exact release date is promised. Before and after launch, we may fix, improve, replace, or discontinue features to maintain security, compatibility, or the product. Where reasonably practicable, material reductions to paid functionality or discontinuation will be announced in advance. We do not promise uninterrupted availability or compatibility with every app, website, macOS release, or text-selection implementation. Mandatory remedies for non-conforming software are not limited.

Yomify uses services and technology provided by Apple, Google, Supabase, Stripe, Cloudflare, dictionary licensors, and open-source projects. Their terms and licenses may apply to the portions they provide. Yomify is not sponsored or endorsed by Apple, Google, or those providers. Third-party terms do not reduce rights you have against Yomify under mandatory law.

We may restrict or suspend account services when reasonably necessary to investigate fraud, payment disputes, security threats, unlawful use, repeated trial abuse, or a material violation of these Terms. We may terminate access for a material violation that is not corrected after reasonable notice, or immediately when urgent action is reasonably necessary to protect users, the service, or comply with law.

You may stop using Yomify at any time. Termination does not erase payment, refund, privacy, intellectual-property, liability, dispute, or other obligations that by their nature should survive. Any suspension or termination remains subject to mandatory consumer rights.

You may request deletion as described in the Privacy Policy. Because paid access is verified through the account, confirmed deletion ends account-linked trial and paid access and signs out connected installations. Before completing deletion, we will explain the effect on your license and ask you to confirm. Records that must be retained for tax, accounting, refunds, disputes, fraud prevention, or other legal obligations may remain for the required period.

Yomify, its interface, code, branding, and original assets remain the property of Kuei Maesaka and applicable licensors. These Terms grant a use license, not ownership.

To the maximum extent permitted by law, Yomify is provided on an “as available” basis without warranties beyond those that cannot legally be excluded. We do not warrant that every reading, OCR result, translation, integration, or feature will be accurate, uninterrupted, error-free, or compatible with every Mac or third-party app. This disclaimer does not limit statutory warranties or remedies that cannot be excluded.

To the maximum extent permitted by law, Yomify and its operator are not liable for indirect, incidental, special, consequential, or lost-profit damages that were not reasonably foreseeable when the contract was made. Where liability may lawfully be limited, aggregate liability arising from a paid license will not exceed the amount you actually paid for the affected Standard, Premium, or Premium-upgrade license.

These limitations do not apply to intentional misconduct or gross negligence, death or personal injury where liability cannot be limited, or any other liability or consumer remedy that Japanese law or other applicable mandatory law does not permit us to exclude or restrict.

To the extent permitted by law, you will indemnify Yomify's operator against a third-party claim and reasonable resulting costs only to the extent directly caused by your intentional unlawful use of Yomify, malicious interference with the service, unauthorized redistribution of the app, or knowing infringement of another person's rights. This does not apply to ordinary consumer use, to loss caused by Yomify, or where an indemnity would impair mandatory consumer rights.

We may update these Terms for legal, security, operational, or product changes. The revised Terms will be posted with a new effective date. Material changes will be announced in the app or on the website before they take effect where reasonably practicable. Changes will not retroactively remove accrued rights, and consent will be requested where required by law.

These Terms are governed by the laws of Japan. The Tokyo District Court or Tokyo Summary Court, depending on the nature and amount of the claim, will be the agreed court of first instance for disputes arising from Yomify or these Terms. This does not limit mandatory consumer protections or jurisdiction rights that apply where you live.

If a provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply and the affected provision will be enforced only to the lawful extent. A failure to enforce a provision is not a waiver. You may not transfer your account or license without written permission. We may transfer these Terms as part of a lawful business reorganization or transfer of Yomify, with notice where required and without reducing mandatory consumer rights. These Terms, the Privacy Policy, Refund Policy, and checkout disclosures form the agreement governing Yomify.
